These Terms of Use constitute a binding agreement governing access to and use of The Psych Archive, including the website, accounts, subscriptions, chat functionality, saved content, and related services.
By accessing or using the service, creating an account, signing in, clicking to accept these Terms, or purchasing a subscription, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, you may not access or use the service.
You represent that you have legal capacity to enter into these Terms. If you use the service on behalf of another person or organization, you represent that you have authority to bind that person or organization.
The Psych Archive provides educational access to AI-generated conversations inspired by historical psychological figures and schools of thought. The service may include guest access, registered accounts, saved conversations, usage limits, subscriptions, and related account-management tools.
We may modify, suspend, discontinue, replace, limit, or remove any feature, content, model, allowance, or functionality at any time, subject to applicable law and any paid subscription terms presented at checkout.
The service is provided for educational and informational purposes only. It does not provide therapy, counseling, diagnosis, medical advice, psychiatric advice, legal advice, financial advice, crisis intervention, or any other licensed professional service.
AI-generated responses may be inaccurate, incomplete, outdated, offensive, biased, or unsuitable for your circumstances. You are solely responsible for evaluating outputs and obtaining appropriate professional advice before relying on any information.
If you believe you may be experiencing an emergency, may harm yourself or others, or need urgent help, you should immediately contact emergency services, a crisis hotline, or a qualified professional in your location.
Certain features require an account. You agree to provide accurate information, keep your credentials confidential, promptly update account information when necessary, and accept responsibility for all activity under your account.
You may not impersonate another person, create accounts through automated means, transfer your account without authorization, or use multiple accounts or browser sessions to evade limits, payment requirements, security controls, or enforcement.
Paid subscriptions, if offered, are billed through Apple In-App Purchase in the iOS app and through supported web payment processors on the website. Prices, renewal periods, included features, taxes, and cancellation terms are shown at checkout or in the applicable billing portal.
Unless otherwise stated at checkout, subscriptions renew automatically until canceled. You authorize the applicable payment processor to charge the payment method on file for recurring fees, taxes, and permitted adjustments. You may manage supported subscription actions through the account page, App Store subscription settings, or the applicable billing portal.
Fees are non-refundable except where required by law or expressly stated by us. Cancellation stops future renewal charges but does not require a refund for the then-current billing period unless applicable law requires otherwise.
You may not use the service to violate law, infringe rights, harass or harm others, exploit or endanger minors, generate unlawful or abusive content, obtain unauthorized access, interfere with service operation, probe or bypass security controls, scrape or harvest data at scale, reverse engineer protected systems, or circumvent usage limits or payment obligations.
We may investigate suspected misuse and may restrict, suspend, or terminate access if we reasonably believe activity violates these Terms, creates risk, exposes us or others to liability, or impairs the service.
You retain ownership of prompts, messages, and other content you submit to the service. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, store, reproduce, display, and use such content as necessary to operate, secure, improve, and support the service and to comply with law.
You represent that you have all rights necessary to submit your content and that your content does not violate law, these Terms, or the rights of any third party. You should not submit confidential, privileged, medical, financial, or highly sensitive information.
The service, software, design, interface, trademarks, branding, curated materials, and underlying technology are owned by us or our licensors and are protected by intellectual property and other laws. No rights are granted except the limited right to use the service in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, or create derivative works from the service except as expressly permitted by us in writing or by applicable law.
The service may rely on third-party providers for hosting, authentication, AI processing, security, analytics, email, payments, and related operations. Third-party services are governed by their own terms and policies, and we are not responsible for third-party services except to the extent required by applicable law.
You may stop using the service at any time and may request account deletion through available account controls. We may suspend or terminate access, delete or restrict content, or refuse service if we reasonably determine that doing so is necessary to enforce these Terms, protect the service, comply with law, prevent harm, or address security, fraud, or operational risk.
To the fullest extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or reliability.
To the fullest extent permitted by law, we and our service providers, licensors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm arising out of or relating to the service or these Terms.
To the fullest extent permitted by law, our aggregate liability for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid for the service during the twelve months before the event giving rise to liability or one hundred U.S. dollars.
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to your content, your use of the service, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. Updated Terms are effective when posted unless a later effective date is stated. Continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms.
These Terms are governed by applicable law, without regard to conflict-of-law rules, except where mandatory law provides otherwise. If any provision is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
